Agreeing to these terms

These Terms of Service (the “Terms”) are an agreement between you and [Legal entity name] (“BreakThru Mindset”, “we”, “us”), the business that operates breakthrumindset.com, the member dashboard, the companion experience, our programs, community and events (together, the “Services”).

By creating an account, making a purchase or otherwise using the Services, you agree to these Terms and to our Privacy Policy and Refund Policy. If you do not agree, please do not use the Services.

What BreakThru Mindset is, and is not

BreakThru Mindset shares personal development philosophy, reflective practices and educational content, including The BreakThru Method, the 90-day program, the Grateful & Becoming journal, courses, community and events.

BreakThru Mindset shares personal development philosophy, reflective practices and the personal experience of its founder. It is not medical, psychological, legal or financial advice, and no particular outcome is promised or guaranteed. Your results depend on many factors, including your own effort and circumstances.

Manifestation, as taught here, is a personal philosophy about attention, belief and action. Where we mention research, we say so; everything else is shared as perspective and practice, not as established science.

  • Not professional advice. Nothing in the Services is a substitute for advice from a qualified doctor, therapist, counselor, lawyer, accountant or financial adviser. If you are in crisis or think you may be in danger, contact your local emergency services.
  • Fasting. Information about fasting is educational and reflects personal and spiritual practice, not a medical recommendation. BreakThru Mindset does not prescribe fasting regimens. Talk with a qualified healthcare professional before changing how you eat, especially if you are pregnant, nursing, managing a medical condition, taking medication, or have a history of disordered eating.
  • No guaranteed results. We do not promise any financial, health, relationship, career or manifestation outcome. Any examples we share are illustrations, not predictions of what you will achieve.

You are responsible for your own decisions and for how you apply anything you learn through the Services.

Your account

  • You must be at least [18] years old, or the age of majority where you live, to create an account or make a purchase.
  • Please give us accurate information and keep it up to date.
  • Keep your password secure and do not share your account. You are responsible for activity that happens under your account.
  • Let us know right away through our contact page if you think someone else has accessed your account.

You can close your account at any time from your account settings or by contacting us.

Memberships, subscriptions and purchases

Prices and payment

Prices are shown on the relevant page and at checkout, together with any taxes that apply. Payments are processed by Stripe, and by paying you also agree to Stripe's terms. We may correct pricing errors, and if a price was shown in error we may cancel the order and refund you.

Automatic renewal

Some memberships, such as the BreakThru Mindset Academy and the BreakThru Inner Circle, are billed on a recurring basis (for example, monthly or yearly). A membership renews automatically at the end of each billing period, using the payment method on file, until you cancel. The billing interval and amount are shown before you confirm your purchase.

Cancelling

You can cancel renewal anytime from your account settings, which open Stripe's secure billing portal. Cancelling stops future charges, and you keep access until the end of the period you have already paid for.

Price changes

If the price of your membership changes, we will tell you at least [30] days before the new price applies to you, so you have time to cancel if you wish.

Refunds

Refunds are covered by our Refund Policy, which forms part of these Terms.

Waitlists and applications

Some programs open by waitlist or application first. Joining a waitlist or applying does not guarantee a place or obligate you to buy.

Digital content and your license

When you buy or are given access to digital content, such as program lessons, videos, worksheets, the digital edition of the Grateful & Becoming journal or Academy courses, we grant you a personal, non-exclusive, non-transferable license to use it for your own personal development, for as long as your access lasts.

You may not copy, share, resell, publish or redistribute our content, share your login so others can access it, or use it to create a competing product, without our written permission. You may print the printable journal for your own personal use.

We may update, improve or retire content over time. If we remove something that is a material part of a program you paid for, we will offer you a reasonable alternative or a fair refund.

Physical products

Physical products, such as the hardcover Grateful & Becoming journal and printed books, are shipped to the address you provide at checkout. Delivery estimates are estimates, not guarantees. The risk of loss passes to you when the product is delivered to the carrier, [unless the law where you live says otherwise]. Returns, damaged items and lost packages are covered in our Refund Policy.

Events, seminars and live sessions

  • Some events are free, some are ticketed and some are for members only. Each event page explains who it is for and what is included.
  • Links to join online events are for registered attendees only. Please do not share them.
  • If a session will be recorded, we will say so in advance. By taking part in a recorded session, you agree that your name, voice and image may appear in the recording if you speak or turn on your camera.
  • We may need to change the date, time, format or speaker of an event. If we do, we will tell registered attendees as early as we can. Ticket refunds are covered in our Refund Policy.
  • Please follow the community guidelines below at all events, online and in person.

Mentorship and coaching

Private Mentorship With Tyson is application-based and places are limited. Submitting an application does not guarantee a place. If we offer you a place, the scope, schedule and fees will be confirmed with you in writing before you pay, and any written mentorship agreement will apply alongside these Terms.

Mentorship and coaching are personal development guidance. They are not therapy, medical care, or legal, tax or financial advice, and they do not guarantee any outcome.

Community guidelines

The BreakThru community exists so people can grow together. To keep it safe and useful:

  • Be respectful. No harassment, bullying, threats, hate speech or discrimination.
  • Protect privacy. Do not share another person's personal information, or anything that was shared with you in confidence, without their permission.
  • Keep it genuine. No spam, unsolicited sales pitches, recruiting or affiliate links.
  • Stay within your expertise. Do not give medical, psychological, legal or financial advice as if you were a qualified professional.
  • Keep it lawful. Do not post content that infringes someone else's rights or breaks the law.

Moderators may hide or remove content, and we may suspend or close accounts that break these guidelines. Members can report content that breaks them, and we review every report.

Your content

You own what you create in the Services, including your journal entries, goals, reflections and community posts.

  • Private content (your journal, goals, habits and reflections) is private to your account. We do not publish or share it. See our Privacy Policy for details.
  • Community content. When you post in the community, you give us a non-exclusive, royalty-free license to host, display and moderate that content so the members of that group can see it. This license ends when you delete the content or your account, except where others have already replied to or quoted it.
  • Feedback. If you send us ideas or suggestions, we may use them without any obligation to you.

You are responsible for the content you post and confirm that you have the right to post it.

Our content and trademarks

The Services and everything in them that we create, including The BreakThru Method, the Grateful & Becoming journal, lessons, videos, worksheets, text, graphics, logos and software, are owned by [Legal entity name] or Tyson E. Sam, or used with permission, and are protected by intellectual property laws.

“BreakThru Mindset”, “Grateful & Becoming”, “The BreakThru Method” and our logos are our brand names. You may not use them in a way that suggests we endorse you, or that is likely to cause confusion, without our written permission.

Acceptable use

When using the Services, you agree not to:

  • access or try to access accounts, data or areas of the Services you are not authorized to use;
  • interfere with or disrupt the Services, or test their vulnerability without our written permission;
  • copy, scrape or harvest content or member information using automated means;
  • reverse engineer the Services, except where the law allows;
  • get around payment, access or security controls;
  • use the Services to break the law or to infringe anyone's rights.

The companion app

The web dashboard is available now. Dedicated iOS and Android apps are in development, and features, timing and availability may change before they launch. When the mobile apps become available, the terms of the relevant app store will also apply to your download and use of them.

Third-party services and links

The Services rely on third parties, such as Stripe for payments, and may link to other websites or embed content from providers such as YouTube or Vimeo. We are not responsible for third-party services or websites, and your use of them is governed by their own terms and policies.

Disclaimers

We work hard to keep the Services helpful, accurate and available, but they are provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Services will be uninterrupted or error-free, or that any particular result will follow from using them.

Limitation of liability

To the fullest extent the law allows, BreakThru Mindset, Tyson E. Sam and our team will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of the Services.

Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the [12] months before the claim arose and [US $100].

Some places do not allow certain limitations of liability, so some of these limits may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

Indemnity

If you break these Terms or the law, or infringe someone else's rights, and that leads to a claim against us, you agree to cover the reasonable costs and losses we incur as a result, to the extent the law allows.

Suspension and termination

You can stop using the Services and close your account at any time. We may suspend or close your account if you seriously or repeatedly break these Terms, if we are required to by law, or to protect members or the Services. Where reasonable, we will tell you why and give you a chance to respond. If we close your account without cause, we will refund any prepaid fees for the unused part of a membership.

Sections that by their nature should continue after termination, such as those about content ownership, disclaimers and limitation of liability, will continue to apply.

Governing law and disputes

These Terms are governed by the laws of [State/Country], without regard to its conflict of laws rules. If a dispute arises, please contact us first; most concerns can be resolved quickly and informally. If we cannot resolve it within [30] days, the dispute will be resolved [in the courts of County, State / by binding arbitration].

If you are a consumer, nothing in these Terms takes away the rights you have under the mandatory consumer laws of the place where you live.

Changes to these terms

We may update these Terms as the Services change. We will update the “Last updated” date and, for significant changes, let you know by email or with a notice in your dashboard before they take effect. If you keep using the Services after the changes take effect, you accept the updated Terms.
